(Compliant with the Saint Kitts and Nevis Data Protection Law, 2017 (DPL))

2.1 Data Controller and Principles

The Data Controller is DIGITAL CONSULTANTS LTD. We are committed to processing personal data in compliance with the DPL. We adhere to the DPL’s eight principles, ensuring data is processed fairly and lawfully, is held for specified and lawful purposes, is adequate and relevant, is accurate, is kept no longer than necessary, is processed in accordance with data subjects’ rights, is protected by appropriate security measures, and is not transferred outside the Saint Kitts and Nevis unless adequate protection is ensured.

2.2 Data Collection and Purposes

We collect personal data primarily for:

  • Service Provision: To fulfill contractual obligations and provide consulting services (Contract basis).

  • Legal Compliance: To meet Anti-Money Laundering (AML) and Know Your Customer (KYC) obligations (Legal Obligation basis).

  • Communications: To send necessary updates and service-related communications (Legitimate Interests basis).

The types of personal data collected may include identity data (name, passport/ID, address), financial data, and technical data (IP addresses, site usage).

2.3 Data Subject Rights (DPL)

Under the DPL, individuals have the following rights:

  1. Right to be Informed: The right to clear and transparent information about how we process data (as outlined in this Policy).

  2. Right of Access: The right to obtain a copy of your personal data (Subject Access Request - SAR).

  3. Right to Rectification: The right to have inaccurate data corrected.

  4. Right to Cease Processing: The right to demand that processing cease in certain circumstances.

  5. Right to Object to Direct Marketing: An absolute right to demand that direct marketing cease or not begin.

  6. Rights in relation to Automated Decision Making.

Requests to exercise these rights must be submitted in writing to the Compliance Officer at main@safeguard.com.

2.4 Data Security and Transfer

We implement robust technical and organisational security measures to protect personal data. Where data is transferred internationally (e.g., to our Saint Kitts and Nevis registered office or trusted third-party data processors), we ensure such transfers comply with the DPL by implementing appropriate safeguards.
